Terms of Service

Please read these terms carefully before using HealthShift

⚠️ By accessing or using HealthShift, you agree to be bound by these Terms of Service.

📖 Definitions

  • "Platform" refers to the HealthShift website, applications, and services
  • "User" refers to both Healthcare Facilities and Healthcare Professionals
  • "Facility" means hospitals, clinics, pharmacies, or other healthcare institutions posting shifts
  • "Professional" means licensed healthcare workers applying for shifts
  • "Shift" refers to temporary healthcare work assignments posted on the platform

👤 Account Registration

Eligibility
  • Users must be at least 18 years old
  • Professionals must hold valid, unexpired licenses from relevant Kenyan regulatory bodies (NCK, KMPDB, etc.)
  • Facilities must be legally registered healthcare institutions
  • Users must provide accurate, complete, and current information
Account Security
  • You are responsible for maintaining confidentiality of your account credentials
  • You must notify us immediately of any unauthorized access
  • HealthShift reserves the right to suspend accounts with suspicious activity
  • One account per user; duplicate accounts may be terminated

🏥 Facility Obligations

Posting Shifts
  • Provide accurate shift details including role, time, location, and requirements
  • Specify fair compensation rates clearly
  • Do not discriminate based on gender, ethnicity, religion, or other protected characteristics
  • Ensure workplace safety and professional standards
Professional Conduct
  • Provide adequate orientation and supervision
  • Pay agreed rates within stipulated timeframes
  • Provide accurate feedback and ratings
  • Maintain professional liability coverage
Prohibited

Direct hiring of HealthShift professionals outside the platform to avoid fees is strictly prohibited and will result in account termination.

👨‍⚕️ Professional Obligations

Qualifications & Verification
  • Maintain current, valid professional licenses
  • Update credentials promptly upon renewal
  • Provide truthful information about experience and qualifications
  • Consent to background and reference checks
Shift Performance
  • Arrive on time and prepared for scheduled shifts
  • Follow facility policies and professional standards
  • Maintain patient confidentiality (HIPAA compliance)
  • Provide 24-hour notice for cancellations except emergencies
  • Submit accurate timesheets and documentation
Grounds for Removal

No-shows, patient complaints, license suspension, or violation of professional ethics will result in immediate account suspension.

💳 Payments & Fees

Facility Fees
  • Free to post shifts
  • Service fee applied to completed shifts
  • Invoices issued weekly/monthly
  • Late payment penalties may apply
Professional Payments
  • Free registration and shift applications
  • Payment within 3-5 days after shift approval
  • M-Pesa or bank transfer options
  • Tax obligations are the professional's responsibility

⚖️ Liability & Disclaimers

  • HealthShift is a matching platform only; we do not employ professionals
  • Facilities are responsible for workplace safety and professional supervision
  • Professionals are independent contractors, not HealthShift employees
  • We do not guarantee continuous availability of shifts or professionals
  • Platform availability may be affected by maintenance or technical issues

Insurance: Facilities must maintain professional liability insurance. Professionals are encouraged to carry personal malpractice coverage.

🚫 Termination

HealthShift reserves the right to suspend or terminate accounts for:

Violation of these terms
Fraudulent activity
Harassment or discrimination
Extended inactivity
License revocation
Platform circumvention

🤝 Dispute Resolution

Any disputes arising from platform use shall be resolved through:

  1. Negotiation: Direct communication between parties
  2. Mediation: HealthShift support team intervention
  3. Arbitration: Binding arbitration under Kenyan law if mediation fails

These Terms are governed by the laws of the Republic of Kenya.

📝 Changes to Terms

We may update these Terms periodically. We will notify users of significant changes via email or platform notifications. Continued use after changes constitutes acceptance.
